Terms of Service

1. The Vendo Service

Vendo is an online marketplace that allows registered users to post, browse, and inquire about second-hand goods and services in Malta. Vendo is a platform provider only — we are not a party to any transaction between buyers and sellers. Vendo does not hold funds, guarantee products, or mediate disputes unless specifically stated.

2. Eligibility

• You must be at least 18 years old to create an account and post listings.
• By registering, you confirm you have the legal capacity to enter into binding agreements under Malta law.
• Each person may hold only one account. Creating duplicate accounts may result in suspension.

3. Account Responsibilities

You are responsible for keeping your account credentials confidential and for all activity that occurs under your account. Notify us immediately at support@vendomalta.com if you suspect unauthorised access.

4. Listing Rules (Acceptable Use)

You may only list items that:

• You own or have the legal right to sell;
• Are accurately described, with honest photos and a fair price;
• Are legal to sell in Malta and the EU.

The following are strictly prohibited:

• Illegal goods or services (weapons, drugs, counterfeit items);
• Adult content or services;
• Live animals;
• Stolen property;
• Financial products (loans, investments, cryptocurrency);
• Spam listings or duplicated posts;
• Misleading or fraudulent listings.

Vendo may remove listings that violate these rules at any time without prior notice.

5. Listing Duration and Renewal

All listings on Vendo are active for 90 days from the date of publication.

• 7 days before expiry, you will receive an email and in-app notification as a reminder.
• After 90 days, your listing status changes to "expired" and it is no longer visible in search results.
• Expired listings can be renewed at any time from your My Listings page using the Renew button, which extends the listing for a further 90 days.
• If a listing is not renewed within 30 days of expiry (i.e. 120 days from publication), it is permanently deleted from the platform and cannot be recovered.

Vendo reserves the right to modify listing duration policies with 14 days' notice.

6. Content Reporting (DSA Article 16)

In accordance with the EU Digital Services Act (DSA), you can report any listing or content you believe is illegal or violates these terms. Use the "Report" button on any listing page. We will review reports within 72 hours and take appropriate action. You will receive feedback on your report.

7. Transactions Between Users

Vendo facilitates contact between buyers and sellers but is not responsible for:

• The quality, safety, or legality of listed items;
• The accuracy of listing descriptions;
• The ability of sellers to sell or buyers to pay;
• Any loss arising from a transaction.

We strongly recommend meeting in a safe, public place for in-person transactions and never transferring money before inspecting goods.

8. Ratings and Reviews

After a confirmed transaction, both parties may leave a rating. Ratings must be honest and based on a genuine transaction. Fake or retaliatory ratings may be removed.

9. Intellectual Property

You retain ownership of content you post (photos, descriptions). By posting, you grant Vendo a non-exclusive, royalty-free licence to display your content on the platform. You must not post content that infringes third-party intellectual property rights.

10. Privacy & Data Protection

Our collection and use of personal data is governed by our Privacy Policy, which forms part of these Terms. We comply with GDPR and the laws of Malta.

11. Termination

We may suspend or terminate your account if you breach these Terms, engage in fraudulent activity, or if required by law. You may delete your account at any time via Settings → Delete Account.

12. Limitation of Liability

To the maximum extent permitted by Malta law, Vendo's liability for any claim arising from use of the platform is limited to the amount you paid to Vendo (if any) in the 12 months preceding the claim. Vendo is not liable for indirect, consequential, or punitive damages.

13. Changes to These Terms

We may update these Terms at any time. We will notify you by email or in-app notice at least 14 days before significant changes take effect. Continued use of Vendo after the effective date constitutes acceptance of the revised Terms.

14. Governing Law and Disputes

These Terms are governed by the laws of Malta. Any dispute that cannot be resolved amicably will be subject to the exclusive jurisdiction of the courts of Malta. EU consumers retain the right to use the EU Online Dispute Resolution platform .
